2. whether, in practice, this requirement is being strictly followed, and enforced ?
3, If not done, what is/are the legal consequence / ramifications ?
The Admn. / author may be pleased to clarify the foregoing points of poser, for the common benefit of one and all concerned / the visitors to the website.
PS: In passing, for general information, as is being canvassed in certain quarters, instead / in substitution of the formality of 'completion certificate' from local authority (e.g. BMC in Mumbai),- simply to be found on rules (paper) but never taken and complied with seriously, - the architect' s certificate might be mandated; so as to make the life of 'buyers' , for that matter even of others including say, BMC, hassle-free and simpler.
1. Yes this format is prescribed by Stamp Duty Authority ,Revenue Department Government Of Maharashtra for calculating proper Stamp Duty on Land , Structure and FSI.
Delete2. Yes this is followed and enforced almost 98%. In 2% some advocate /agent manage the officer by some way and the officer not take this certificate.
3. If not then society may not pay stamp duty on Point No 19 , 25 then this property will not transfer to society they legally & technically belong to land owner / developer so society will not get clear title certificate. Also at any point of time Stamp duty recovery may come.
This is not in substitution of Completion certificate. Most important is Occupancy Certificate given by local authority after occupancy certificate flat owner are have right to occupancy of the flat. By this architect's certificate Stamp Duty department collect proper stamp duty on land , structure and FSI. For eg. Consider If building construct in 1965 in Bandra , Mumbai at that time their is 0.75 FSI on plot area . Plot are is 1000 Sq. Mtr. Now conveyance deed is done in 2014. If society has Completion certificate , Occupancy Certificate but Builder use only 0.50 FSI so 0.25 FSI balance so how come stamp duty authority come to know this. OR say builder take 0.25% TDR and construct building then stamp duty authority check is Stamp duty paid on TDR or not. Basically this certificate is for cross check with construction plan, land area etc.

ReplyDeletePlot type society is register after after punching plot i.e. Conveyance is already done in the name of society then plot is distribute to member.
