We are the Group of Flat Owners who are now members of the Society and managing the society, we have some issues yet to resolve with the Builder, and Old Committee (Promoter) people i.e. Chairman, Secretary and Treasurer.
We have made complaint through advocate to Inspector of police for lodging FIR against them, CC was to concerned MHADA Authorities.
We want to know :
Whether society, can file Writ Petition against said MHADA authorities to look in to Complaint filed to Police Station (CC to the said Authorities)?
Whether Consent of Registrar of Societies is required for same?
Under what section of MCS Act can it be covered? What is Section 73F of MCS Act? Can we file suit on relying on said Section?
The complaint was sent to Poilce Station for filling FIR, the Copy of same was sent to MHADA Authorities as C.C.
the Mhada Authorities had not taken any Steps, hence we wanto know Can we On basis of Said Complaint letter (which was CC to MHADA), file Matter in Court ?
We are planning to approach The Magistrate for getting direction for lodging complaint against the Ex Chairman, Secretary. -
A flat in our society is in the name of a husband and wife. They have three major children. The husband expired in 2000. The society transferred the share certificate in the wife's name in 2002. The wife wants the society's bill to be transferred to her name as well as to change the name on the society's board from the late husband's to hers. Please note that there is no death certificate in the society's record. Also, the consent of the children has not been taken. Please advise on procedure to transfer the bill to wife's name and whether the name on notice board can be changed. Thank you very much.
