  1. Sir we got a society having 168 members. Our MC had conducted AGM where no 14 days clear notice given. Plus the audited report circulated were with many errors. We required catagory B auditor but they did the audit from catagory C auditor. Thus the accounts were not adopted. Same happened in last year AGM of 2014. What are our rights to complaint against MC or can they become disqualified due to deliberate presentation of wrong account and non adoption of accounts, no appointment of auditor. Thanks in advance.

  2. You have collectively write letter to Dy. Registrar of C.S. of your area that Society has not given proper AGM notice and also Penal Auditor appoint by the MC is class C auditor who is not qualified for doing audit of our society. Auditor has done many mistake so AGM has not adopted the account so inform the MC to pay the all exp. from their own pocket.

  3. Visariya ji, what is the responsibility of co-operative federation offices? Do they just collect CHS documents, or is this where the Registrar sits? Do they handle CHS matters and grievances? Your help appreciated. Thanks in advance.

    1. Federation Is apex body housing society of that district. Every housing society has to become member of the federation. They collect basic document like society registration certificate photo copy and society contact details. Federation handle CHS matter and grievances and also sell necessary forms and stationery required for Housing society

  5. WHEN 2 DISPUTANTS FUNCATION IN MC MEMBER THEN 100 % CONFLICT OF INTEREST

    MCS ACT 1960 & RULE 1961, ANY GR IS SUPREME OVER GENERAL BODY

    IFMORE THAN 50 % MEMBER RESIGN THEN Dy. Registrar will dissolved the committee and take new election

We are proposing to form a housing society exclusively for sc/st. do we need to include persons from general/obc category as well? is it compulsory by law or left to our discretion? if compulsory by law, what percentage of obc/general category members should we include? please provide any rules/act/law which we can refer to in this regard. thank you.

  9. Since when flat owners are liable to pay the monthly outgoings to a newly registered society. Are the owner liable to pay outgoings on per sq ft basis to the so called adhoc committee formed before the election of chief promoter by few members in which chief promoter elected later on was also the member of adhoc committee.Can the First General Meeting give recognition to such adhoc committee.
