Nomination Forms

Here is Nomination Form in Triplicate i.e. 1 Set. Please fill all 3 copies as they are given in the Set i.e. Original , Duplicate & Triplicate. Fill 1 Set for one owner. i.e. If the flat is purchased by 2 people jointly then fill 1 set for 1 owner whose name stand first in the Agreement and another set for 2 owners whose name stand second in the agreement. I have found many people / Agent are taking 1 forms from Set and give 2 Xerox copy of same. This is a totally wrong approach.

    No PMC compulsory in society redevelopment

    It is common knowledge that society needs a Project Management Consultant (PMC) compulsorily according to circular of government of Maharashtra. But this circular was withdrawn and now there is no such compulsion.
    The department of Co-operation had issued a circular which said that society going in for Redevelopment Process must statutorily appoint PMC from the recommended list of the department. Later it was withdrawn and now it seems, many fraudsters are claiming that they are on the panel of Government of Maharashtra and it is compulsory to have PMC if society wants to go for redevelopment.
    In fact, society can them selves do the redevelopment and manage the redevelopment process. PMC also appoint architects, Lawyers and other professionals which society can also directly appoint and negotiate with builders.
    Builders are reluctant to go for redevelopment of a society if PMC is appointed because PMC black mail builder and ask for under the table compensation to give the project to builder. In a long period, PMC often ask big compensation and do not clear bills and documentation in the name of tenders and other process.
    Agents of PMC are active and take small meetings in society and force them to go for PMC. Hardly any society put an advertisement in newspaper to appoint the PMC.

  2. The Govt. Of Maharashtra has issued the circular No. CHS 2007/CR554/14-C,CO-OPERATION & MARKETING Dept. Dated 03/01/2009. which contain the directive of Sec 79[A] of MCS Act 1960 for redevelopment of Housing Society. You have to follow all this directive. First you should get feasible report for redevelopment. Society can appoint Architects, RCC Consultant , Lawyers etc. Their is no need to appoint PMC. But all directive given in the circular must full fill.

    1. YES SRA is for Slum Rehabilitation Authority it is register by Dy. Registrar of C.S. SRA.
      Where as if SRD society is built under the same plot but having different wing then it is register by Dy. Registrar C.S. MHADA. But if it develop on other plot/pravite plot using the FSI of SRA then it is registered by Dy. Registrar C.S. of that Ward

    Can i just take a printout of these and submit it to my society duly filing them up . Will that work or do i have to get these from a legal documentaion service only ?

  6. Take print out on Legal Paper [Green Paper ] fill the form and submit it in your society office.

    1. Umm , i have no idea what green paper is . Do i have to get it from a place where they do legal documentation or some store close to courts that may keep this ? . sorry for too many questions , never dealt with all these legal issues before .

  7. If you ask xerox store near your place he/she can give you green/ legal paper. OR you may find it store close to courts or typiest near courts.

  8. Hi sir , i am a joint holder of one flat in mumbai with my mother being the first name on the share certificate . I am the only legal heir to her as my father passed away and the both of our names were then transferred to certificate . Im the second name on the share certificate and the only legal son , is it still necessary to register myself for a nomination by my mother ?

  9. yes for you mother share i.e. 50% of total share mother has to make nomination to any person/trust/co. and for your 50% share you have to make nomination to any person/trust/co.
