We pay our property tax collectively in the name of society. What is the best solution in your opinion? 2) Is there any provision/compulsion for forming grievances and cultural committee in the co-operative society? Please guide in details like no. of members of the grievances committee. Duties and responsibilities etc. 3) For society bank account, is there any upper limit of keeping balance amount. 1. ask the both ex-servicemen to go to Municipal body with exemption certificate and reduce property tax to 0 against their flat and take new bill copy. 2. No. their is no provision for grievances and cultural committee. 3. No upper limit you can keep any amount
Thanks Visariyaji. If I understand it properly, The ex-servicemen can get the exemption if they produce exemption certificate to the municipality though we are paying the property tax in the name of the society. Regards, Mandar

Share certificate is issue as per name written in the Statement A. Statement A is given to registrar while forming Society. If in statement A suppose flat owner on 2 floor name is written 1 then flat owner on gr. floor is written then you have to issue share certificate in that order.

If both the individuals are joint owners of the flat? 2) We have adequate parking for the members and some scope for Emergency vehicles like Ambulance, Fire Brigade and Police. We wish to provide for one or two parking for the visitors. Can we implement parking charges for the visitors on hourly basis? 3) To implement the bye laws and AGM decisions we intend to have a penalty structure for the breach of such points. Can you please guide us on the various penalties and their min. and max limits if any as per the Law.
1. No. 2. for visitor parking no charges for 24 hrs 3. for this you have to decide since in your society which type of breach is done is not known to me. For penalties min. Rs. 500/- and max. Rs. 5000/-
Generally we give NOC to members to avail Housing Finance/Loan from Banks or financial institutions and we mark lien in favour of the financiers .. One of the members has approached society asking to mark lien his shop in favour of say "x" person from whom he has taken loan to meet his personal need. He has submitted application for the same signed by him as well as the person from whom he has taken loan along with copy of loan documents.We do not know whether Mr."x" is money lender and whether he is having license for the same. Can society accept the request of the member? If yes please guide the precautions to be taken in the above case.

Any suggestions?? 3) I have heard from some friends that some societies charge registration fees from the property dealers involved in buying / selling / renting of the flats. Is it legal?
1. For Civil Work now society is taking Security deposit along with indemnity bond for leakage problem in neighbouring flat. But this has to approve in AGM. 2. you can allowed ads. in notice board by taking charges per day. Allow activity in society from Co. by taking charges. Charges can be fixed by AGM. Normally Rs. 1000/- to Rs. 5000/- charged per day. 3. This is not legal. This involves tax liability to society

No. If person does not have money lender valid license then you can not mark lien

Since I am not staying there I don't know.
They didn't informed us. No they are asking to pay Rs.28,000/-
Society has to inform you. Ask them to give per sq. ft. rate which member has to pay and depending upon your flat area you have to pay this.
