Note:
1. On the death of member society has to inform the Nominee in written in 1 month after the death of the member that nominee has to transfer the share with in 6 months from the death of member and produce the document as per Case No 1. If there is no nominee register in Nomination Register of society than then society has to inform the all person of that flat to produce the document as per Case No.2
2. If will is done then in both case society has to transfer as per will and follow the process as nomination is done. Get the will certified copy.
3. If nominee come after 6 months from the death of member then society have to give paper advertise in 2 paper asking any claim on that flat
4. If no nomination done by member than paper advertise for asking objection by Advocate is must and along with advocate report 2 copy of that 2 news paper must be keep with society

ReplyDeleteI am the owner of a flat on 1st floor facing water leakage problem from my toilet ceiling for which I have already shown to the flat owner of 2nd floor and Society Authorised Officer. I asked to 2nd floor flat owner to get rid of the problem and whatever the expenses will share by both party. But he refusing to pay.
Please let me know what is the actual procedure?

As per Bye-Laws No. 159(a)(xiv) this repair cost is carried out by the society at its cost.
ReplyDeleteEven if its internal leakage, who will bear the cost the society or the flat owner if there is a leakage from one flat to another?
ReplyDeleteAs per bye-laws society has to bear the cost if no changes in flat structure including flooring else flat from which leakage is happen.
DeleteThe leakage is from 7 th floor flat from his bed room and thus its coming on the ceiling of the 6th floor flat.both the parties having ego issues and due to this the 6 th floor ownee has stopped paying the maintance since 2 years.he is asking society to convince the 7 th flat owner to co-operate but the 7 th floor flat owner IS refusing.now what should the society do in this matter?
ReplyDeleteFile Recovery case against flat owner 6th floor U/S 101 of recovery to recovery dues. For 7th floor owner file case in co-operative court to take access permission and do the needful repair and repair cost should be recover from 7th floor owner
DeleteWho will file the case on the 7 th floor owner...soicety or 6 th floor owner? N if the SOCIETY will file then who will bear the cost and expense,fees for the case?'"
DeleteSociety has to file case and what ever is expense charged this to 7th floor flat owner.
