Rights of member in a CHS

The rights of member in a CHS is as follow

1. A member is entitled to occupy the flat allotted to him

2. Member can appoint Associate member / Nominal member

3. A member is entitled to receive a copy of registered Bye-Laws of the  society on payment of price.

4. A member is entitled to inspect, free of cost, the following documents
   i.   A copy of Maharashtra Co-op. Societies Act
   ii.  A copy of Maharashtra Co-op. Societies Rules
   iii. Register Bye-Laws of the Society
   iv. Last Audited Report along with Balance Sheet, Profit and Loss a/c
   v.  List of member of the committee
   vi  List of member of the society
   vii Minutes of the general body / special general body meetings
   viii Minutes of the committee meetings
   ix   Those portions of the books and records in which the member's transaction with the society are recorded. The member can inspect the documents in the  society's office during office hours or at the time fixed by the society for the purpose
x  A member is entitled to receive copies of  any documents referred to above, if the member make a request in writing and pays the prescribed fees. If the member makes such an application, the society has to furnish the copies to the member within 1 month from the date of receipt of the prescribed fees


5.  A member is entitled to attend the general body

6.   A member contest election for committee and hold office subject to the he/she is not defaulter of society   and other conditions stipulated in the Bye-Laws of the society

  1. Water leakage from above flats...
    Why should water leakages from the flats above to the flats below not be attended by the Cooperative Housing Society Managing Committee?
    Does any society member take permission of the flat owner staying below his flat for his opinion before carrying out the Repairs and Renovations of the flat?
    Is it not the Society Managing Committee who grants permission for the Repairs and Renovations of the flat to its members?
    Is not the Society responsible for the so many other Repairs of the Society?
    Does any one force a society member to buy the terrace flat?
    It is bought out of choice so why should the society do the repairs of the terrace leakages?
    Why then in the case of Terrace Repairs, it becomes a society responsibility.

    Any Answers: Do the solicitors have any opinion?
    Can the Cooperative Housing Society Registering Authority give any opinion?

    if the Managing Committee is not taking any responsibility to repair such negligent water leakages..
    Grieved members who suffer from such water leakage in their flats due to the work carried out above their flats should report such matters to with photographs :
    Local Area Municipality (Buildings Department).
    Lodge a Police Complaint in their area.
    Report it to the Cooperative Deputy Registrar of Cooperative Society.

  2. Muttu I think you are current Managing Committee Member or X Managing Committee Member of your Society who facing above problem. OR Solicitors / Advocate and 1 of your client Society want above problem solution.Please inform me regarding this.

    Solicitors can give their opinion after taking their legal fees and by viewing paper submit to him/her.

    Grieved Member have to first inform the society MC in written about his/ her problem. If problem is not solved by MC then he/she should approach to the Advisory Committee constituted by the General Body of the society and then after he/she should approach to Local Area Municipality,Police Station and Registrar of C S this is the complaint redressal system.

    No member shall, without the previous written permission of MC of society can do any additions or alterations in his/her flat as per Bye-Laws No. 47[a]

    Terrace is common area it is not own by particular person ownership of terrace is for society, so any leakage form terrace has to done by society

    Leakage from flat has to done by above flat owner from whose flat water leakage is done in below flat due to renovations

    You can not force any one to not to buy OR buy the Terrace flat it the flat is in the budget of the person the he/she buy that flat.
    No one buy flat beyond his/her budget

  3. My query is: I am owner of flat in Nalasopara and want to know that is there any law/act to charge penalty for absentisum for general & annual meeting? I am relocated in gujarat for service since 2 yrs and unable to attained monthly & annual meeting held by society. Now charges against absentisum Rs. 200/Monthly meeting & Rs. 1000/AGM have been started by society.

    1. Yes their is GR of charging PENALTY if member is absent in AGM. But no GR for Monthly Meeting. GR is post in my blog please find that.

  4. Members can see all financial transaction records of society like bank statement bank passbook

    1. yes. but for that you have to give request letter to MC with your date and time so that they can give all records at available date.

  5. share register, associate member register, nomination member register can inspect under section 32(1) and obtain copy under section 32(2). Registrar can also denied to inspect me above documents?

  6. inspection of tenders & other docs is not listed in Art.32 does it mean that a member has no right to inspect such docs.The committee members refuse to give inspection of such records.In which rule or law it is stated that a member cannot inspect such docs.They do not come under exemption clause.How can committee members refusr to give inspection?
